Virginia Consumer Data Protection Act (VCDPA) Notice

Effective Date: March 21, 2025

This notice supplements the information contained in our Privacy Policy and Consumer Data Policy and applies solely to residents of the Commonwealth of Virginia. Dates and Honey adopts this notice to comply with the Virginia Consumer Data Protection Act ("VCDPA"). Any terms defined in the VCDPA have the same meaning when used in this notice.

Personal Data Collection and Processing

Pursuant to the VCDPA, we disclose that we collect and process the following categories of personal data:

Identifiers and contact information (name, address, email address, telephone number, account credentials)
Commercial information (subscription status, transaction history)
Internet or other electronic network activity (device information, browsing history, app usage)
Geolocation data
Professional or employment-related information
Inferences drawn from other personal data (preferences, characteristics, predispositions)

We may also collect and process sensitive data as defined by the VCDPA, including:

Precise geolocation data
Sexual orientation
Racial or ethnic origin
Religious beliefs

Purposes of Processing

We process the personal data specified above for the following business purposes:

Providing and maintaining our services
Processing and fulfilling user requests
Improving, upgrading, and enhancing our services
Protecting against malicious, deceptive, or illegal activity
Developing new products and services
Performing services on behalf of the business, including maintaining or servicing accounts and providing customer service
Verifying user information
Advertising and marketing services, excluding targeted advertising without consent
Internal research for technological development

Disclosure of Personal Data

We may disclose certain categories of personal data to third parties for business purposes. When we disclose personal data for a business purpose, we enter into a contract that describes the purpose and requires the recipient to keep that personal data confidential and not use it for any purpose except performing the contract.

Consumer Rights Under VCDPA

If you are a Virginia resident, the VCDPA provides you with specific rights regarding your personal data, including:

Right to Access: You have the right to confirm whether we are processing your personal data and to access such personal data.
Right to Correction: You have the right to correct inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of your personal data.
Right to Deletion: You have the right to delete personal data provided by or obtained about you.
Right to Data Portability: You have the right to obtain a copy of your personal data that you previously provided to us in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another controller without hindrance, where the processing is carried out by automated means.
Right to Opt Out: You have the right to opt out of the processing of your personal data for purposes of (i) targeted advertising, (ii) the sale of personal data, or (iii) profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

Exercising Your Rights

To exercise the rights described above, please submit a verifiable consumer request to us by either:

Please note that our legal office at this address is not open to the public or visitors. All inquiries should be submitted via email or postal mail.

Your request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal data
Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it

We will respond to consumer requests within 45 days of receipt. If we require more time, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the 12-month period preceding receipt of the request.

Appeals Process

If we decline to take action regarding your request, we will inform you of our decision and reasoning. If you wish to appeal our decision, you may do so by submitting your appeal to privacy@datesandhoney.com with the subject line "VCDPA Appeal". We will respond to your appeal within 60 days of receipt.

Verification Process

To protect your privacy and maintain security, we take steps to verify your identity before granting access to your personal data or complying with your request. We may require you to provide additional information to verify your identity and authority to make the request.

Non-Discrimination

We will not discriminate against you for exercising any of your VCDPA rights. Unless permitted by the VCDPA, we will not:

Deny you goods or services
Charge you different prices or rates for goods or services
Provide you a different level or quality of goods or services
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services

Consent for Processing Sensitive Data

By using our services and providing your sensitive data as described above, you expressly consent to our processing of such data in accordance with this notice and our Privacy Policy. You may withdraw this consent at any time by contacting us at privacy@datesandhoney.com.

Changes to This VCDPA Notice

We reserve the right to amend this notice at our discretion and at any time. When we make changes to this notice, we will post the updated notice on our website and update the notice's effective date.
